pepperbrandstudio.lt rules for buying and selling goods

Payment can be made using the electronic banking services of Swedbank, Seb, Luminor, Citadele, Šiauliai and other banks. Settlements are possible in euro currency. Payments are processed using the MakeCommerce.lt payment platform.

1. General provisions.

1.1. These rules for the purchase and sale of goods (hereinafter - the Rules) are a binding legal document for the Buyer and "MB Pepper Brand" (hereinafter - the Seller), which determine the rights and obligations of the Parties, the conditions and procedures for the conclusion of the Purchase and Sale Agreement, delivery and return, as well as other provisions related to the purchase and sale of goods in the online store www.brandstudio.lt .
These Rules are prepared in accordance with the Civil Code of the Republic of Lithuania, the Law on the Protection of Consumer Rights of the Republic of Lithuania, the Electronic Commerce Directive and by-laws.
1.2. The buyer agrees to these Rules by registering on the website of the online store www.peppperbrandstudio.lt .
1.3. The following are exclusively entitled to register and purchase goods in the online store www.pepperbrandstudio.lt :
1.3.1. Active natural persons, that is, persons who have reached the age of majority, whose capacity is not limited by court order;
1.3.2. minors between the ages of 14 and 18 only with the consent of their parents or guardians, except in cases where they dispose of their income independently;
1.3.3. legal entities.
1.4. By agreeing to the Rules, the buyer confirms that, based on 1.3 of these Rules. point, has the right to register and buy goods in the online store www.pepperbrandstudio.lt .

2. Conclusion of the purchase-sale contract.

2.1. The contract between the Buyer and the Seller is considered to be concluded when the Buyer, after choosing the product(s) to be purchased and creating a shopping cart (hereinafter referred to as the Shopping Cart), clicks on the "Complete order" link.
2.2. Upon conclusion of the Purchase-Sale Agreement, the assortment of goods, their quantity, price, delivery time and other conditions specified during the execution of the Buyer's order are binding on the Buyer and the Seller, and can only be changed in accordance with the procedure set forth in these Rules.
2.3. Purchase and sale contracts are registered and stored in the www.pepperbrandstudio.lt database.
 
3. Buyer's rights

3.1. The buyer has the right to buy goods in the online store www.pepperbrandstudio.lt in accordance with these Rules.
3.2. The buyer has the right to withdraw from the purchase-sale agreement concluded with the online store www.pepperbranstudio.lt , by notifying the seller in writing (by e-mail, specifying the item to be returned and its order number) no later than within 14 (thirty) days of the delivery of the quality item delivery days. Having purchased a low-quality product, the Buyer has the rights provided for by Lithuanian legislation.
3.3. The Buyer's right discussed in point 3.2 is implemented in accordance with Article 6.22810, Part 1 of the Civil Code.
3.4. The Buyer can exercise the Buyer's right discussed in point 3.2 only if the product has not been damaged or its appearance has not fundamentally changed, as well as if it has not been used.
3.5. Having purchased a low-quality product, the Buyer has the rights provided for in the legal acts of the Republic of Lithuania.
3.6. Cancellation or adjustment of the ordered and formed Shopping Cart is possible only during the sale of goods. After the end of the sale of goods, there is no possibility to cancel or adjust.
 
4. Seller's rights.

4.1. If the Buyer tries in any way to harm the work of the online store, data security or violates other obligations of the Buyer mentioned in point 6, then the Seller has the right to cancel the Buyer's registration or otherwise limit the possibility to use the online store www.pepperbrandstudio.lt .
4.2. When the buyer chooses to pay for the goods in cash by picking up the goods or after paying in advance and fails to contact the Buyer within the specified term according to the chosen delivery method, then the order is canceled and returned to www.pepperbrandstudio.lt .
 
5. Obligations of the buyer

5.1. The buyer must pay for the purchased goods and accept them in accordance with the procedure provided for in these Rules.
5.2. If the Buyer, during the delivery of the goods, refuses to accept the goods without valid reasons, the Buyer must cover the costs of returning the goods at the Seller's request.
5.3. The buyer undertakes to protect and not transfer to third parties his login data to the online store www.pepperbrandstudio.lt . If the Buyer loses his login data, he must immediately inform the www.pepperbrandstudio.lt customer service department.
5.4. The seller is not responsible for the actions of third parties after using the Buyer's login data until the moment of notification and the opportunity for the online store administrator to change the Buyer's login data. In this case, www.pepperbrandstudio.lt has the right to assume that the actions in the online store were performed by the Buyer.
5.5. Buyers of the online store www.pepperbrandstudio.lt must comply with these Terms and Conditions, clearly indicated in the information sections of the online store, and must not violate the laws of the Republic of Lithuania.

5.6 The buyer must notify the seller about non-compliance with product quality requirements no later than three months from the date of detection of the non-compliance.


6. Obligations of the seller

6.1. The seller undertakes to make it possible to use the services of the online store, the operating conditions of which are determined by these Rules and other conditions published in the online store www.pepperbrandstudio.lt .
6.2. The Seller undertakes to deliver the goods purchased by the Buyer by the delivery method chosen by the Buyer, based on the conditions set by these Rules.
6.3. The Seller undertakes to respect the Buyer's right to privacy regarding his personal information.
6.4. When, due to unforeseen circumstances, the Seller cannot deliver the goods purchased in the online store www.pepperbrandstudio.lt , the Seller has the right to terminate the Purchase and Sale Agreement by notifying the buyer beforehand. The seller can offer a similar product. If the buyer refuses, the seller undertakes to return the money paid as soon as possible, but no later than within 5 working days.
6.5. After the buyer uses Rule 4.2. the right provided for in point 4.4 of the Rules. clause, the Seller undertakes to return the money paid to the Buyer within 7 (seven) days from the day he received the Buyer's notice of withdrawal from the contract together with the returned goods.
6.6. The Seller may not refund the amount paid to the Buyer until the goods are returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, whichever occurs first.
 
7. Prices of goods

7.1. The prices of goods in the online store and in the order made at www.pepperbrandstudio.lt are indicated in the currency circulating in the country. VAT is included in the price, after confirmation of the order, the delivery fee is added to the total amount of the goods, except in cases where the Seller offers free delivery for a limited time.

7.2. The retail (reduced) prices presented in the sale are provided by the suppliers or official distributors of the goods for sale. Reduced product prices are the manufacturer's recommended retail sales prices, which are sold at the sellers' direct sales points, sales showrooms and stores .

7.3. The previous price is the lowest price that the Seller has charged in the last 30 days.

8. Procedure and terms of payment for goods

8.1. The buyer pays for the purchased goods in one of the following ways:
8.1.1. Electronic banking: directly - "Swedbank", SEB; Luminor bankas, Medicinos bankas, Citadele bankas, Šiaulių bankas, Paysera, Paypal.
8.1.2. After choosing the credit card payment method, you can make a direct transfer if the order amount does not exceed 2172.15 EUR (the amount may change due to changing exchange rates).
8.1.3. In cash or by bank card upon delivery of the order. It is possible to pay in cash at the time of order collection, when the order amount is up to 1000 EUR.
8.2. When paying via electronic banking, the buyer undertakes to pay for the goods immediately. Only after he has paid, the goods parcel will be formed. If the order is not paid within 1 hour, the order is removed from the system. If the sale of goods ends before the deadline (1 hour), orders are removed after the end of the sale of goods.
8.3. If the buyer chooses delivery via post machines or couriers - payment of the order is possible only in advance via e-mail. by banking or bank transfer.
 
9. Delivery of goods

9.1. When purchasing goods in the online store www.pepperbrandstudio.lt , the buyer chooses the delivery method: the delivery service.
9.2. Goods delivery service:
9.2.1. The buyer, having chosen the goods delivery service, undertakes to provide the exact delivery address of the goods;
9.2.2. The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer does not have the right to make claims to the Seller regarding the delivery of the goods to the wrong entity;
9.2.3. The goods can be delivered by the Seller himself or his authorized representative;
9.2.4. Delivery fee in Lithuania after choosing delivery:
to the Omniva post machine: EUR 2.99;
through the Omniva courier service (except the city of Neringa): 4.99 EUR;

Instead of delivering the goods, the Buyer can choose to pick up the goods free of charge at www.pepperbrandstudio.lt pick-up points:

In Vilnius, Outlet Park : Verkių st. 31C, 09108, I-VII 10:00 - 20:00;

In Kaunas, PC Molas : K. Baršauska st. 66A, I-VI 10:00 - 20:00, VII 10:00 - 19:00;

In Marijampole : V. Kudirkos 3, I-VI 10:00 - 20:00, VII 10:00 - 19:00.

9.2.5. The buyer will see the exact amount of the shipping fee before confirming the order. The amount of the delivery fee will not be changed after the order is confirmed.
9.3. The seller provides the terms of delivery of the goods in the payment window of the order. Usually, goods are delivered in Lithuania within 1-3 days, but no later than within 30 days from the date of conclusion of the contract (unless the parties have agreed otherwise). The Seller undertakes to inform about changes in the delivery term and in this case, if the Seller does not have the ordered product. In all cases, the Seller undertakes to obtain the Buyer's consent to extend the delivery term. If the user does not agree to extend the contract term, he has the right to terminate the contract and recover the money paid as soon as possible.
9.4. The Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to circumstances beyond the Buyer's control.
9.5. After receiving the goods, the Buyer must, together with the Seller or his authorized representative, check the condition of the shipment (whether the outer packaging is not damaged) and sign the invoice, waybill or other shipment transfer and acceptance document. After the buyer signs the invoice, waybill or other document of delivery and acceptance of the shipment, it is considered that the shipment has been delivered in a suitable condition.
Having noticed that the package of the delivered package is damaged (crumpled, wet or otherwise externally damaged), the Buyer must note this in the invoice, waybill or other document of delivery and acceptance of the package and, in the presence of the Seller or his representative, draw up a free-form package violation act. If the Buyer does not perform these actions, the Seller is released from responsibility for damage to the goods, if the basis for the occurrence of such damage is not a factory defect, and for inconsistencies in the composition of the goods, if these inconsistencies can be determined by inspecting the outside of the goods.
If the Buyer, upon receiving the shipment, notices a discrepancy in the goods, a factory defect or other defects in the goods, he shall inform the Seller immediately (no later than within 24 hours of receiving the shipment). If the complaint about the inappropriate quality of the goods is confirmed and the Buyer returns the goods of inappropriate quality, the Seller undertakes to return the money for the goods as soon as possible, but no later than within 5 days, while also covering the return costs.
Buyers must immediately inform www.pepperbrandstudio.lt after collecting parcels from Omniva post machines and noticing discrepancies .
9.6. The characteristics of all goods sold are indicated in the description attached to each item. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the real size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.
9.7. When the Buyer cancels the goods purchase-sale agreement, all amounts paid by the Buyer are returned to the Buyer, including the costs of delivery of the goods paid by the Buyer. However, as provided for in Article 6.22811 of the CC of the Civil Code of the Republic of Lithuania. 3. The seller is not obliged to reimburse the user for additional costs incurred due to the fact that the user has clearly chosen a different delivery method than the cheapest (standard) delivery method offered by the entrepreneur. Taking this into account, in the event that the Buyer has not chosen the cheapest delivery method (through Omniva/DPD post machines), when returning a quality item, you will not be reimbursed for the additional costs incurred due to the fact that you have chosen a delivery method other than the cheapest one offered by the Seller.

10. Return of goods

10.1. Quality goods can be returned within 14 days of receipt.  Inappropriate quality goods or quality goods, the shape, size, color, model or completeness of which the Buyer does not like, are exchanged or returned according to Retail trade rules, approved by the Resolution of the Government of the Republic of Lithuania on 11.06.2001 no. 697 (wording of Resolution No. 738 of the Government of the Republic of Lithuania 2014-07-22, hereinafter - Retail Trade Rules) and to the provisions of the Civil Code.

10.2. In order to return the product(s), the Buyer must, in accordance with 11.1. point and fill out the online product return form, which can be found in the "Returns" section. If the goods return form is not filled in, the Seller will not be able to confirm the return.
10.3. The following conditions must be met when returning goods:
10.3.1. The returned item must be in its original, neat packaging (this clause does not apply in the case of returning a defective item);
10.3.2. The product must be undamaged by the Buyer;
10.3.3. The product must be unused, without losing its commercial appearance: intact label, untorn protective film, etc. (this clause does not apply in the case of returning a defective product);
10.3.4. The returned quality product (within 14 days) must be in the same package as the one received by the Buyer (this clause does not apply in the case of returning a low-quality product);
10.3.5. When returning the product, it is necessary to present the purchase document and the completed return document;
10.3.6. The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods were not met;
10.3.7. Returns are free of charge in physical stores. The price of returning goods through Omniva post machines - 2.00 EUR;
10.3.8. The return of goods is carried out in the manner determined by the Seller within 14 (fourteen) days from the day of receipt of the goods (this point does not apply in the case when the goods are of poor quality - they can be returned within 2 years from the day of delivery of the order if the order was placed online. If the goods were purchased in a physical store - 2 years the term is calculated from the day of purchase of the goods);
10.3.9 If a defective product is returned, the return does not cost the customer - these costs are covered by the Seller.
10.4. The return and exchange of goods of suitable quality is carried out in accordance with Article 6.22810 of the Civil Code;
10.5. Money for returned goods can be returned in cash (when returning goods at www.pepperbrandstudio.lt goods collection points only if the order was paid in this way). By bank transfer to the payer's bank account, the money is returned within 5 (five) working days from the delivery of the goods to the warehouse/physical store.
The Seller is not responsible for the incomplete or delayed order for the returned goods, if the Buyer incorrectly provides the data required for the return.

10.6 P the buyer must notify the seller of non-compliance with product quality requirements no later than three months from the date of detection of the non-compliance.


11. Exchange of information


11.1. The Seller informs the Buyer using the e-mail provided in the registration form. e-mail address, and the Buyer can use all communication channels specified in the "CONTACTS" section of the website of the online store www.pepperbrandstudio.lt .

12. Liability

12.1. The buyer is fully responsible for the correctness of the data provided in the registration form. If the Buyer provides inaccurate data in the registration form, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation for the direct losses suffered by the Buyer.
12.2. The buyer is fully responsible for his actions after registering at the online store www.pepperbrandstudio.lt .
12.3. The buyer is responsible for the security of his registration data. If the registration data is used by a third party, he will be considered the Buyer.
12.4. The Seller is released from any responsibility in all cases where losses occur due to the Buyer's failure to familiarize himself with these Rules, regardless of the Seller's recommendations and his obligations (although he was given such an opportunity).
12.5. In the event of damage, the guilty party compensates the other party for the losses incurred in accordance with the procedure and grounds established by the legal acts of the Republic of Lithuania.
 
13. Final Provisions

13.1. www.pepperbrandstudio.lt reserves the right to suspend, at its own discretion, fill in and change these Rules and other documents related to the Rules. Additions or changes to the rules take effect from the day of their publication (by informing about the changes by e-mail, newsletters, by placing the information on the website www.pepperbrandstudio.lt ).
13.2. If the Buyer does not agree with the new version of the Rules, partial additions, changes, the Buyer has the right to refuse them, provided that the Buyer loses the right to use the services of the online store.
13.3. These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
13.4. Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.
13.5. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
13.6. The Parties are exempted from fulfilling their obligations under these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties, which include:
fire, explosion, storms and other natural disasters and natural forces that prevent the fulfillment of assumed obligations or delay their fulfillment;
an event or circumstance that cannot be controlled by the contracting party (Parties) and which prevents the fulfillment of assumed obligations or delays their fulfillment;
Actions by the government or authorities that prevent or delay the fulfillment of assumed obligations;
13.7.
